1. Definitions

1.1 - "Buyer" means the person who agrees to buy the goods from the seller;

1.2 - "Conditions" means the terms of the sale set out in this document and any special terms agreed in writing by the seller;

1.3 - "Goods" means the articles which the buyers agrees to buy from the seller;

1.4 - "Price" means the price for the goods excluding carriage and any of charges that may incur;

1.5 - "Seller" means Toucan Tool Co. Ltd;

2. Conditions

2.1 - These conditions apply to all contracts for the sale of goods from the seller to the buyer;

2.2 - Orders placed for goods by the buyer shall be deemed as conclusive evidence of the buyer's acceptance to these conditions;

2.3 - Any variations to these terms shall be made inapplicable unless agreed in writing by the seller;

2.4 - These terms & conditions apply to all purchases made by the buyer on any instruction from the website;

2.5 - These terms & conditions may change at any time without any given notice;

3. Price and Payment

3.1 - The price shall be the price quoted on the website unless any errors occur in which we reserve the right to cancel, supply any goods at the incorrect prices and issue the buyer a credit the buyer will be notified in these such circumstances;

3.2 - We the seller reserves the right to change any prices at any time without notification;

3.3 - Payment must be made in full including any carriage charge's before any order is processed;

4. Availability

4.1 - All products listed are stock items unless specified, but if however we are unable to fulfill the order because items are out of stock or no longer available we may offer a substitute or offer a full refund.

5. Cancellation & Returns

5.1 - You may cancel your order by given us notice before any delivery of goods is made, such notice may be given in person or by phone;

5.2 - If any goods are faulty or damaged the you must notify us within 3 days of delivery;

5.3 - You may return unwanted items unused in original undamaged packaging and original new condition within 28 days of purchase with a copy of the original receipt. Any delivery costs will not be refunded unless item is damaged or faulty.

5.4 - Replacement of a faulty item received by the customer will be despatched

upon return of the defective product, please contact support@toucantools.co.uk for an RMA number.    

6. Delivery & Acceptance of Goods

6.1 - Unless you order & collect the goods from our store, delivery will be made to the address specified on your order;

6.2 - A valid signature will be required on collection or delivery of goods;

6.3 - Upon delivery of goods to you, the goods shall be at your risk;

6.4 - If we are unable to obtain a valid signature on delivery, the buyer may incur further carriage charges;

6.5 - Delivery can only be made to U.K. Mainland only excluding Isle of man, Scottish Isles, Isle of Wight and Northern Ireland;

6.6 - A Purchase can only be made by persons aged 18 or over;

6.7 - Delivery must be received only by persons aged 18 or over; Proof of age may be asked by Delivery Drivers

6.8 - Collections must only be made by persons  aged 18 or over;

6.9 - CAN I CHOOSE A SAFE PLACE OR DROP OFF POINT WITH DPD?

One of the best features of using DPD as our courier is that they allow you to take control of your delivery.

DPD text and email you with a delivery window on the morning of delivery.

You can choose for your parcel to be delivered to a safe place around your home or at a DPD drop off point.

IMPORTANT: should you choose to have the parcel delivered to a place other than the address on your order (i.e. the safe place or drop off point), DPD and Toucan Tools Co. LTD are not liable should the parcel become damaged or goes missing.

7. Risk

7.1 - The consumer must report any damage, shortage or incorrect goods to the company within seven (3) days of delivery either:

7.2 - The risk in goods sold to the Client shall pass to the Client so that the client is responsible for loss, damage or deterioration of the goods or a part thereof at the time of delivery;

8. General

8.1 - All web-site content (design, images and text) is the copyright of Toucan Tool co. Limited and it's suppliers. The content may not be copied or removed, nor may the site be altered or republished in any way;

8.2 - Toucan Tools does not disclose buyers' information to third parties other than when order details are processed as part of the order fulfilment. In this case, the third party will not disclose any of the details to any other third party.

Cookies are used on this shopping site to keep track of the contents of your shopping cart, to store delivery addresses if the address book is used and to store your details if you select the 'Remember Me' Option. They are also used after you have logged on as part of that process. You can turn off cookies within your browser by going to 'Tools | Internet Options | Privacy' and selecting to block cookies. If you turn off cookies, you will be unable to place orders or benefit from the other features that use cookies.

8.3 - Electronic Communications

When the Buyer places an order they agree the Seller may use the Buyers email and phone number solely to keep them up to date with the delivery of the order placed as well as an email of the Buyers Vat invoice. We the Seller may also need to notify the Buyer of any problems with fulfilling the order. The Buyer therefore agrees when providing their mobile number and email that we the seller may provide the designated courier with your mobile solely for the purpose of updates with your order and we may email a copy of an invoice to the Buyer. 

When purchasing a Festool / Mafell Machine the Buyer agrees to appoint the Seller to register the tool with the manufacturer for the purpose of receiving the Extended 3 year warranty using the customers name and address.
