TERMS & CONDITIONS

1. Definitions

1.1 – “Buyer” means the person who agrees to buy the goods from the seller;
|
1.2 – “Conditions” means the terms of the sale set out in this document and any special terms agreed in writing by the seller;
|
1.3 – “Goods” means the articles which the buyers agrees to buy from the seller;
|
1.4 – “Price” means the price for the goods excluding carriage and any of charges that may incur;
|
1.5 – “Seller” means Toucan Tool Co. Ltd;
|
2. Conditions
|
2.1 – These conditions apply to all contracts for the sale of goods from the seller to the buyer;
|
2.2 – Orders placed for goods by the buyer shall be deemed as conclusive evidence of the buyer’s acceptance to these conditions;
|
2.3 – Any variations to these terms shall be made inapplicable unless agreed in writing by the seller;
|
2.4 – These terms & conditions apply to all purchases made by the buyer on any instruction from the website;
|
2.5 – These terms & conditions may change at any time without any given notice;
|
3. Price and Payment
|
3.1 – The price shall be the price quoted on the website unless any errors occur in which we reserve the right to supply any goods at the incorrect prices, but the buyer will be notified in these such circumstances;
|
3.2 – We the seller reserves the right to change any prices at any time without notification;
|
3.3 – Payment must be made in full including any carriage charge’s before any order is processed;
|
4. Availability
|
4.1 – All products listed are stock items unless specified, but if however we are unable to fulfill the order because items are out of stock or no longer available we may offer a substitute or offer a full refund;
|
5. Cancellation & Returns
|
5.1 - You may cancel your order by given us notice before any delivery of goods is made, such notice may be given in person or by phone;
|
5.2 – If any goods are faulty or damaged the you must notify us within 3 days of delivery;
|
6. Delivery & Acceptance of Goods
|
6.1 – Unless you order & collect the goods from our store, delivery will be made to the address specified on your order;
|
6.2 – A valid signature will be required on collection or delivery of goods;
|
6.3 – Upon delivery of goods to you, the goods shall be at your risk;
|
6.4 – If we are unable to obtain a valid signature on delivery, the buyer may incur further carriage charges;
|
6.5 – Delivery can only be made to U.K. Mainland only excluding Isle of man, Scottish Isles, Isle of Wight and Northern Ireland;
|
6.6 – Purchases can only be made by persons aged 18 or over;
|
7. Risk
|
7.1 - The risk in goods sold to the Client shall pass to the Client so that the
client is responsible for loss, damage or deterioration of the goods or a
part thereof at the time of delivery;

8. General
|
8.1 - All web-site content (design, images and text) is the copyright of Toucan Tool co. Limited and it’s suppliers. The content may not be copied or removed, nor may the site be altered or republished in any way;
|
8.2 - These terms & conditions are subject to the law of England & Wales
